Acceptance of Terms

By downloading, installing, or using the Sculptr mobile application ("App"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the App.

Description of Service

Sculptr is a mobile application that allows users to create 3D sculptures using voxel-based tools, save their creations, and optionally share them in a public gallery. The App is designed to provide a peaceful, stress-relieving creative experience.

License Grant

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to:

• Download and install the App on your compatible iOS device
• Use the App for personal, non-commercial purposes
• Create and save sculptures using the App's tools
• Share your sculptures in the public gallery (optional)

User Conduct

You agree not to:

• Use the App for any illegal or unauthorized purpose
• Create or share content that is offensive, inappropriate, or violates others' rights
• Attempt to reverse engineer, modify, or hack the App
• Use the App to distribute malware or engage in fraudulent activities
• Interfere with or disrupt the App's servers or networks
• Create sculptures that infringe on intellectual property rights

Content and Intellectual Property

Your Content

You retain ownership of the sculptures you create using the App. By sharing content in the public gallery, you grant us a non-exclusive license to display, store, and distribute that content within the App.

Our Content

The App, including its design, features, and underlying technology, is owned by us and protected by intellectual property laws. You may not copy, modify, or distribute any part of the App without our permission.

Public Gallery

The public gallery feature allows users to share their sculptures with the community. By using this feature, you acknowledge that:

• Your shared sculptures will be visible to other users
• We may moderate content for appropriateness
• We reserve the right to remove content that violates these Terms
• You can remove your sculptures from the gallery at any time

Privacy

Your privacy is important to us. Please review our Privacy Policy, which explains how we collect, use, and protect your information when you use the App.

Subscriptions and In-App Purchases

Sculptr offers optional premium features through the following options:

• Sculptr Pro Monthly - $0.99/month, auto-renews monthly
• Sculptr Pro Lifetime - $9.99 one-time purchase

Auto-Renewal Terms

Monthly subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. Your App Store account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.

Managing Subscriptions

You can manage and cancel your subscriptions at any time by going to your App Store account settings. To cancel, go to Settings > [Your Name] > Subscriptions on your iOS device.

Refunds

Payment will be charged to your Apple ID account at confirmation of purchase. No refunds will be provided for the unused portion of any subscription term, except as required by applicable law. Refund requests must be directed to Apple through their standard refund process.

Disclaimers

The App is provided "as is" without warranties of any kind. We disclaim all warranties, including but not limited to:

• Merchantability and fitness for a particular purpose
• Non-infringement of third-party rights
• Uninterrupted or error-free operation
• Security of data transmission or storage

Limitation of Liability

To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or other intangible losses resulting from your use of the App.

App Store Terms

Your use of the App may also be subject to the terms and conditions of the platform from which you downloaded the App (e.g., Apple App Store). In case of conflict between these Terms and the platform terms, the platform terms shall prevail.

Termination

We may terminate or suspend your access to the App at any time, with or without notice, for any reason, including violation of these Terms. You may stop using the App at any time by deleting it from your device.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of the App constitutes acceptance of the modified Terms.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Colorado, United States, without regard to conflict of law principles.
